THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. October 27, 2020, pursuant to adjournment on October 20, 2020. Commissioners present were: Bender, Beninga, and Karsky. Commissioners Heiberger and Barth were present via Zoom Videoconference. Also present were Olivia Larson, Commission Recorder, and Maggie Gillespie, Senior Deputy State’s Attorney.

The Minnehaha County/Lincoln County Human Services 3rd Quarter Report, the September 2020 Juvenile Detention Center Report, and the 2020 3rd Quarter Juvenile Detention Center Report were received and placed on file in the Auditor’s Office.

Carey Deaver, Human Resources Director, presented Administrative Services Agreements with Horizon Agency, Sanford Health Plan, Avera Health Plans, Inc. dba Avera Health Plans Benefit Administrators, and UMR, Inc. for the County’s self-funded group health plan.
The agreement with Horizon Agency is to work with the county’s third-party administrator and the care systems to assist in addressing claim processing and network issues. The agreement provides for a $6.50 per employee per month fee for network management; which is the same rate as the current agreement. The only change from the current agreement would be the updated term dates commencing on January 1, 2021, and remaining effective until December 31, 2023.
Sanford Health Plan is one of the care systems for the Minnehaha County’s self-insured health plan. The agreement with Sanford reflects a fee increase of 10% for network re-pricing, customer services, pre-certification, utilization management, and case management services. Because the fees will not increase in 2022 or 2023, the increase averages less than 3.5% each year. 
Avera Health Plans, Inc. dba Avera Health Plans Benefit Administrators is one of the care systems for the Minnehaha County’s self-insured health plan. The new agreement would be the fourth amendment to the original Administrative Services Agreement and would increase between 2.5% and 2.7% each year for network repricing and customer service support fees. Fees for utilization management and large case management will increase between 2.4% and 2.8% each year.
UMR is the third party administrator who processes payments and explanations of benefits for the County. The Financial Renewal and Terms Amendment to the Administrative Services Agreement for the county health plan with UMR, Inc. reflects a medical claims increase of 3% in 2021 and 2% in both 2022 and 2023. Additionally, there will be a 2% increase of the stop loss interface fee for 2022 and 2023.
MOTION by Beninga, seconded by Karsky, to authorize the Chair to sign the following agreements: the Administrative Services Agreement between Minnehaha County and Horizon Agency beginning January 1, 2021 and ending December 31, 2023; the Administrative Services Agreement between Minnehaha County and Sanford Health Plan effective January 1, 2021 and ending on December 21, 2021 with automatic renewals for additional one year terms; the Fourth Amendment to the Administrative Services Agreement between Minnehaha County and Avera Health Plans, Inc. dba Avera Health Plans Benefit Administrators effective January 1, 2021, and ending December 31, 2023; and the Financial Renewal and Terms Amendment to the Administrative Services Agreement with UMR, Inc. effective January 1, 2021. LEGISTLASTIVE AUDIT REPORT
Joshua Shellum, Auditor for South Dakota Department of Legislative Audit, reported on the Management Letter and Communications Letter that summarize the findings of the fiscal and compliance audit for Minnehaha County 2019 year end.
BUDGET SUPPLEMENT
Lori Montis, Human Services Assistant Director, via teleconference, requested an automatic budget supplement for funds awarded to the County by the City of Sioux Falls through the One Sioux Falls Fund. To date, approximately $400,000 was accepted from the One Sioux Falls Fund with approximately $398,000 spent to help approximately 365 households with rent, utilities, and mortgage assistance. MOTION by Karsky, seconded by Beninga, to approve an automatic budget supplement in the amount of $288,000 for One Sioux Falls monies from 4110000-369025, Private Grants, to 4110000-422925, One Sioux Falls-Shelter. By roll call vote: 5 ayes.
OWNER AUTHORIZED TRANSFER
Carol Muller, Commission Administrative Officer, requested the approval of a change order in the form of an Owner Authorized Transfer (OAT) #0129 for the Minnehaha County Jail Expansion with JE Dunn to provide remediation in the event of heavy rainfall. The OAT results in a total cost of $520,012.05 for north frontage improvements including a 30-inch wall, a flood gate, and a collection/pump system. The funds for the additional cost will come from the construction contingency. MOTION by Karsky, seconded by Beninga, to approve Owner Authorized Transfer #0129 with JE Dunn Construction Company at a cost of $520,012.05 for north frontage improvements. By roll call vote: 5 ayes.
WORK ORDERS
DJ Buthe, Highway Superintendent, via Zoom Videoconference, requested approval of Tyler Technologies Work Orders for Contract Management and Project Accounting modules. Highway project funding issues were discovered in June 2020. To remedy the issues, it was determined the two additional modules through the County’s MUNIS provider, Tyler Technologies, was needed. The modules are specifically designed for the management of project financials and will assist the Highway Department in cost tracking for all contracted services, in-house maintenance, and purchasing. Monte Watembach, Information Technology Director, via teleconference, spoke on his support of the Highway Department purchasing the additional modules. MOTION by Beninga, seconded by Karsky, to authorize the Chair to sign the Tyler Technologies Work Orders for Contract Management and Project Accounting modules at a total one-time cost of $26,770 and a total annual fee of $1,361. By roll call vote: 5 ayes.
AGREEMENTS
DJ Buthe, Highway Superintendent, via Zoom Videoconference, presented an agreement between the State of South Dakota and Minnehaha County for reimbursement to the County for maintenance and repair costs related to Highway Project No. MC20-02. The Highway Department completed 15.9 miles of asphalt mill and overlay as part of the County’s pavement preservation program. A portion of the work was done on the Crooks/Renner 1-90 Exit. The South Dakota Department of Transportation will reimburse the County in the amount of $20,413.02 for the 630 feet of asphalt mill and overlay done. MOTION by Barth, seconded by Karsky, to authorize the Chair to sign the Reimbursement Agreement between Minnehaha County and the State of South Dakota Department of Transportation in the amount of $20,413.02 for County Highway Project MC20-02. By roll call vote: 5 ayes.
Craig Dewey, Assistant Commission Administrative Officer, presented an Interim Agreement between Minnehaha County and JLG Architects for the Administration and Extension Building Remodel. The Interim Agreement will remain in effect until a full agreement for the remodel can be finalized. Per the Interim Agreement, JLG Architects will provide three steps of services to develop conceptual and schematic level documents, design development level documents, and complete construction documents. The preliminary project budget is $4.6 to $5 million for the Administration Building and $234,000 to $648,000 for the Extension Building. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the Interim Agreement between Minnehaha County and JLG Architects for the Administration and Extension Building Remodel beginning October 21, 2020, and ending November 30, 2020. By roll call vote: 5 ayes.
LIAISON REPORT
Commissioner Barth reported on the October 26, 2020, Planning Commission Meeting where items were approved including an Air B&B.
Commissioner Karsky reported on the October 27, 2020, Public Defender’s Advisory Board Meeting he and Commissioner Heiberger attended. Although the budget is doing well, there have been seven homicides since March. This is expected to cause expenditures to increase greatly in future years. Space needs were discussed including the conversion of physical files to electronic and the possibility of remodeling the lower level of the building.
Commissioner Bender reported on sitting in on interviews for the Jail’s new medical provider. A contract will be negotiated with a local provider and be brought forward to the Commission for final approval.
NEW BUSINESS
Commissioner Bender reported that, as a result of the Audit Report received from the South Dakota Department of Legislative Audit, Moody’s has given Minnehaha County an A1 rating. This rating indicates that the County’s bonds are high quality and subject to low credit risk.
OLD BUSINESS
Commissioner Karsky reported there will be no Commission Meeting on November 3, 2020, due to the General Election.
Commissioner Bender reported the burn ban was lifted thanks to the recent moisture in the County.

The Commission adjourned until 9:00 a.m. on Tuesday November 10, 2020.
