THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. June 16, 2020, pursuant to adjournment on June 9, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

LIEN COMPROMISE

Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 20218 in the amount of $3,651.32. The lien represents Public Defender, Poor Relief, and Court Appointed Attorney services provided to the applicant’s ex-spouse between January 1986 and December 2012. The applicant and her ex-spouse were divorced on October 31, 1989. The lien is attached to property owned by the applicant in Sioux Falls. In order to sell the property, the applicant’s compromise request was to release her name and the real property from the lien with no payment, leaving the full amount of the lien against her ex-spouse. MOTION by Heiberger, seconded by Barth, to approve Resolution MC20-32. By roll call vote: 5 ayes.

RESOLUTION MC20-32

WHEREAS, a County Aid Lien in the amount of $3,651.32, purports to exist in favor of Minnehaha County and against DPNO 20218 as Lienee, and 

WHEREAS, said lienee has filed an application with the County Auditor stating such facts as provided for by Law,

NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:

Release from DPNO 20218 with no payment, the name of the applicant and the real property legally described as Lot 4 in Block 3 of Bylsma Addition to the City of Sioux Falls, Minnehaha County, South Dakota; located at 3134 N Jessica Ave, Sioux Falls.

Leave DPNO 20218 only in the name of the Lienee in the full amount of $3,651.32.

PRESENTATION

Erin Srstka, University of South Dakota Community Projects Director, presented on Minnehaha County Pretrial Services including the history of pretrial services, public safety assessment data, pretrial monitoring expansion, case processing, policies and procedures, and the impact of COVID-19. Amanda Petersen, Pretrial Coordinator, spoke on the utilization of facial recognition technology for the monitoring program. Holly Hansen, Pretrial Coordinator, gave a demonstration of the facial recognition technology through the SCRAM TouchPoint mobile monitoring application. Michelle Boyd, Programs and Services Manager, introduced Jasmine Thelen, Deputy Sheriff Corporal, who assists with Pretrial, the 24/7 Program, and Electronic Monitoring. Ms. Boyd spoke on Pretrial Services being the beginning of the process from the time someone is arrested until their court appearance. Ms. Boyd and Ms. Srstka responded to questions from Commissioners regarding the budget for Pretrial Services.

AMENDMENT

Jamie Gravett, Juvenile Detention Center Director, presented, via Zoom Video Conference, the third amendment to the Food Service Management Agreement between Minnehaha County and Summit Food Service. The amendment would extend the contract for an additional year. The Consumer Price Index allows for a 3.5% change in pricing. For the 2020-2021 school year, lunch and breakfast will be $2.424 with snacks at $0.897. Federal meal patterns, uniform administrative requirements, cost principles, and audit requirements will be followed. MOTION by Beninga, seconded by Barth, to approve the third amendment to renew the fixed price Food Service Management Agreement between Minnehaha County and Summit Food Service effective July 1, 2020 through June 30, 2021. DJ Buthe, Highway Superintendent, presented, via Zoom Video Conference, fourteen Federal Aid Bridge Replacement Program Resolutions. The South Dakota Transportation Commission approved a new Local Federal Bridge Replacement Program in March 2020. The program allows local government entities with a bridge structure at a rating of Poor in the National Bridge Inventory to be eligible to apply for federal funding. The Highway Department identified fourteen structures that meet the requirements to apply for the funding. At this time, the program provides 81.95% federal funding with a local match of 18.05%. LIAISON REPORTS

Commissioner Bender reported the first meeting of the Accessible Housing Advisory Board was held. The board will be looking for five at-large members.

NEW BUSINESS

Commissioner Barth commented on federal funds from the CARES Act received by the State of South Dakota and where those funds are being distributed. Commissioner Heiberger stated the South Dakota Association of County Commissioners is working with the Governor’s Office regarding COVID-19 expenses. Commissioner Beninga spoke on the initial use of funds for COVID-19 testing.
