The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, September 2, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Tim Jorgenson, David Kull and Jack Parliament.  Present via phone conference call was Barb Fish and Mayor Jim Heinitz.  Other’s present were: City Administrator, Bryan H Read; Finance Officer, Christina Smith; City Engineer, Tami Jansma; Public Works Director, Rollie Hoeke; Police Chief, Jamie Steffel; Park Superintendent, Devin Coughlin and Golf Course Manager, Andrew Bauer.  Absent: None.

The Council discussed items on the agenda for the upcoming September 7, 2021 regular Council meeting.  No formal action was taken. 

At 6:11 p.m., hearing no further business, the meeting adjourned.

The Brandon City Council met in regular session at 6:00 p.m. on September 7, 2021 in the Council Chambers at 308 S. APPLICATION FOR RETAIL ON-SALE LIQUOR LICENSE

A public hearing was held, as advertised, to consider an application for a retail on-sale liquor license at 507 N. Splitrock Blvd., for On My Tab, Inc.  Alderwoman Clark moved Alderman Kull seconded to approve the application as presented.  Motion carried.

ORDINANCE #635

A public hearing was held, as advertised, to consider Ordinance #635.  Alderman Jorgenson moved Alderwoman Fish seconded to give first reading to Ordinance #635: TITLE: AN ORDINANCE OF THE CITY OF BRANDON, SD, AMENDING THE BRANDON ZONING ORDINANCE TO CLARIFY THE REGULATIONS OF DRIVEWAYS ASSOCIATED WITH COMMERCIAL & INSTITUTIONAL LOTS, BY AMENDING CHAPTER 15-14-3(A)(8), ADDITIONAL USE REGULATIONS, OFF-STREET PARKING.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull, Parliament aye.  Motion carried.

A public hearing was held, as advertised, to consider Ordinance #636.  Alderman Parliament moved Alderman Jorgenson seconded to give first reading to Ordinance #636: AN ORDINANCE OF THE CITY OF BRANDON, SD, AMENDING THE BRANDON ZONING ORDINANCE BY AMENDING CHAPTER 15-5-2, R-2: MEDIUM DENSITY RESIDENTIAL DISTRICT, PERMTTED USES; CHAPTER 15-5-3, R-2: MEDIUM DENSITY RESIDENTIAL DISTRICT, CONDITIONAL USES; CHAPTER 15-5-11, R-2: MEDIUM DENSITY RESIDENTIAL DISTRICT, LOT AND YARD REGULATIONS; CHAPTER 15-6-2, R-3: HIGH DENSITY RESIDENTIAL DISTRICT, PERMITTED USES; CHAPTER 15-6-11, R-3: HIGH DENSITY RESIDENTIAL DISTRICT, LOT AND YARD REGULATIONS; AND CHAPTER 15-22-2, DEFINTIONS, DEFINITIONS.  John Burkman, 104 N. ELOFSON SAFETY & ANNEXATION CONCERNS

Dave & Sandy Elofson, 1102 N. Chestnut Blvd., were present for discussion.  Dave expressed their concerns with safety as it relates to construction of the new water tower on N. Chestnut Blvd.  Concerns with traffic and staging, unloading of vehicles, open trenches and no safety flags.  Tami Jansma, City Engineer, gave a project update.  Spencer Schenk, 920 N. Chestnut Blvd, was present for discussion.  Spencer had concerns with his driveway being blocked, contractors using the road as a staging area.  Jess Elofson, 1104 N. Chestnut Blvd, was present for discussion. 

Dave Elofson addressed the annexation study being done on the east side of Brandon.  Dave & Sandy Elofson requested to be removed from the annexation process under the City guidelines found in the Brandon Comprehensive Plan.  

STORM WATER PRESENTATION: AE2S

Jacob Strombeck, AE2S, was present for discussion.  Jacob gave a presentation on the Stormwater Utility Implementation plan.  This plan would adopt a stormwater utility fee which would help pay for stormwater infrastructure capital, operation and maintenance.  This fee would be added to the monthly water/sewer bills, or to the yearly property tax bills.  No action required at this time.

ORDINANCE #638

Alderwoman Clark moved Alderman Jorgenson seconded to give second reading to Ordinance #638: TITLE: AN ORDINANCE TO AMEND TITLE FIFTEEN OF THE ZONING ORDINANCE OF THE CITY OF BRANDON, SOUTH DAKOTA.  A roll call vote showed Clark, Fish, Jorgenson, Kull, Parliament aye; David nay.  Motion carried.

FEMA COURSE REPAIR PROJECT UPDATE

The Golf Course Committee report was heard.  Christina Smith, Finance Officer, gave an update on the FEMA golf course repair project.  Alderman Parliament moved Alderman Jorgenson seconded to move forward with Phase 2 – Golf Course Bunker & Turf Project.  Motion carried.  A final proposal will be submitted from Landscapes Unlimited at the September 20, 2021 regular Council meeting.

HIRE PART TIME EMPLOYEES

Alderwoman Clark moved Alderwoman David seconded to approve the following new hires for the Golf Course.  Motion carried.

Pro Shop/Cart Attendant: Eric Foss, $9.45 per hour

Community Room: Graycyn Gruber, $9.45 per hour

ASPEN PARK PROJECT CHANGE ORDER

The Parks & Recreation Committee report was heard.  Alderwoman Fish moved Alderwoman David seconded to approve change order #2 to SiteWorks, Inc. in the amount of $500.00 for the Aspen Park project.  Motion carried.

REQUEST TO USE MCHARDY PARK

A request was received by Alliance Communications to use McHardy Park on October 14 or 15, 2021 for a celebration for their customers.  Will include yard games and a food truck.  Alderwoman Fish moved Alderwoman Clark seconded to approve the request as presented.  Motion carried.

SUMMER RECREATION REPORT

The Brandon Summer Recreation end of year report for 2021 was presented.  No action required.

HIRE NEW EMPLOYEE

Alderwoman Fish moved Alderwoman Clark seconded to approve the hiring of Nicholas Gundermann for the open position of a full time Parks Maintenance Specialist at a starting wage of $17.98 per hour, step 8-3 on the pay scale.  Motion carried.

REQUEST TO USE ASPEN PARK

A request was received from Haley Zerr, Special Olympics South Dakota, to use the Aspen Park ballfields on September 18 or 19, 2021.  Alderman Kull moved Alderwoman Fish seconded to approve the request as presented.  Motion carried.

SALARY REVIEW AND ADJUSTMENT

The Public Safety Committee and Administration Committee reports were heard.  Alderman Kull moved Alderwoman Clark seconded to approve the annual salary adjustment for Melissa Labahn, to step 8-13 on the wage scale, $22.53 per hour, effective September 13, 2021.  Motion carried.

ORDINANCE #639

Alderwoman Clark moved Alderwoman Fish seconded to give first reading to Ordinance #639: TITLE: AN ORDINANCE PROVIDING FOR THE APPROPIRATIONS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2022 AND ENDING DECEMBER 31, 2022, AND LEVYING THE PROPERTY TAX FOR THE YEAR 2021 by amending and adding an additional full time position in the Engineering Department at $20.00 per hour, with benefits.  A roll call vote showed Clark, Fish, Parliament aye; David, Jorgenson, Kull nay.  Mayor does not vote in case of a tie, as this is an appropriation.  Motion failed.  

Alderwoman Fish moved Alderman Jorgenson seconded to readdress the issue of the buydown for the health insurance that was 75, 50, 25, 5.  This was changed at the last meeting to 25, 25, 25, 5.  Alderwoman Fish would like to leave at the 75, 50, 25, 5.  Alderman Kull discussed going with 25% and extend it for 5 years versus the 3 years.  A roll call vote showed Fish, Jorgenson aye; Clark, David, Kull, Parliament nay.  Motion failed.  

Alderman Kull moved Alderwoman David seconded to change the health insurance buydown to 25% for 5 years, with the 6th year dropping down to the 5%.  A roll call vote showed Fish, Jorgenson, Kull, Parliament aye; Clark, David nay.  Motion carried.

Alderwoman David moved Alderman Jorgenson seconded to give first reading to Ordinance #639: TITLE: AN ORDINANCE PROVIDING FOR THE APPROPIRATIONS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2022 AND ENDING DECEMBER 31, 2022, AND LEVYING THE PROPERTY TAX FOR THE YEAR 2021 by amending and adding back in the part time office assistant, along with the full time finance position.  Alderman Kull discussed eliminating the part time office assistant we currently have, to hire one full time finance assistant. Alderman Kull would like to amend the budget and add the part time office assistant back into the budget, along with the full time finance assistant.   A roll call vote showed Jorgenson, Kull aye; Clark, David, Fish, Parliament nay.  Motion failed.  

Alderwoman David moved Alderman Kull seconded to give first reading to Ordinance #639: TITLE: AN ORDINANCE PROVIDING FOR THE APPROPIRATIONS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2022 AND ENDING DECEMBER 31, 2022, AND LEVYING THE PROPERTY TAX FOR THE YEAR 2021.  A roll call vote David, Jorgenson, Parliament aye; Clark, Fish, Kull nay.  Mayor does not vote in case of a tie, as this is an appropriation.  Motion failed. 

Special budget meeting will be held on Thursday, September 9, 2021 at 5:30pm.  

CONTRACT WITH SECOG FOR REDISTRICTING PROJECT

Alderwoman David moved Alderwoman Clark seconded to approve the SECOG redistricting contract, as presented.  Motion carried.

RESOLUTION #18-21

Alderman Jorgenson moved Alderwoman David seconded to approve Resolution #18-21.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull, Parliament aye.  Motion carried.  It was the consensus of the Council to set the rate at $0.50 per capita.  A resolution will be presented at the next City Council meeting.

RESOLUTION #18-21

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRANDON, SOUTH DAKOTA PLACING A MORATORIUM ON ISSUING ADDITIONAL OFF SALE LIQUOR LICENSES.

WHEREAS, the City of Brandon is allowed by the State of South Dakota to issue a limited number of Off Sale Liquor Licenses based on population, and 

WHEREAS, the 2020 US Census numbers, by State Law, allow the City of Brandon to issue one additional Off Sale Liquor Licenses, and

WHEREAS, many questions have arisen on issuing additional licenses including, but not limited to, appropriate recipients and sale price.

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Brandon, South Dakota that a moratorium be placed on issuing additional off sale liquor licenses until the issues listed above can be resolved. This moratorium does not apply to transfers of existing liquor licenses.

RESOLUTION #19-21

A RESOLUTION OF THE CITY OF BRANDON TO LEVY A FRONT FOOT ASSESSMENT FOR ANNUAL MAINTENANCE OF STREET SURFACES AS PROVIDED FOR IN SDCL 9-43-138.

WHEREAS, SDCL 9-43-138 provides for the assessment of an annual maintenance fee for the repairs and maintenance of street surfaces of lots abutting a public street; and

WHEREAS, the City of Brandon maintains and repairs street surfaces on the public streets within the city limits; and

WHEREAS, lots assessed include residential, commercial, churches, schools, private roads if city maintains and more; and

WHEREAS, lots excluded are those along state highways, private roads not maintained by the city and city property; and 

WHEREAS, the Brandon City Council has discussed the maintenance fee required to fund annual maintenance activities on public streets at an acceptable level during their 2022 budget work sessions and budget hearings.

THEREFORE BE IT RESOLVED that the assessment of an annual maintenance fee for street surfaces shall be levied for 2022 as follows:

I. All lots so assessed shall be at the rate of $ 2.50 per front foot.

II. A detailed list of the legal descriptions, amount of front feet and amount of the assessment shall be provided to the Minnehaha County Auditor for collection with taxes.

BE IT FURTHER RESOLVED that all revenue received from this levy be placed in a special revenue fund named “Street Maintenance Fund” for improvements to public streets.

DRAFT DEVELOPMENT DIRECTOR JOB DESCRIPTION

A draft job description was presented for the Development Director position.  Alderwoman Fish moved Alderwoman Clark seconded to approve the draft job description as presented.  Motion carried.

TRANSIT GRANT AGREEMENT WITH SDDOT

The Street Committee report was heard.  Alderman Jorgenson moved Alderwoman Clark seconded to approve the SDDOT 5310 grant agreement, as presented.  Motion carried.

DGR PROPOSAL FOR THE STATE WATER PLAN

The Water & Sewer Committee report was heard.  Alderwoman Clark moved Alderwoman David seconded to approve the proposal with DGR to assist with the State Water Plan Application.  Motion carried.

WATER TOWER PAY APPLICATION

Alderwoman Clark moved Alderwoman David seconded to approve pay application #4 to AB Contracting in the amount of $571,867.20 for the water tower project.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull aye; Parliament nay.  Motion carried.

At 8:18 p.m. on a motion by Alderwoman Clark seconded by Alderwoman David the meeting was adjourned.  Motion carried.

HEARINGS

Public Hearing presented by Rhonda Bennett, Deputy Auditor, MOTION by Beninga, seconded by Heiberger, to approve a Special Event On-Sale Liquor License for Prairie Pasta Inc. dba Johnny Carino’s for an event of September 25, 2021 to be held at the Baltic Event Center. No one from the public spoke for or against this request. 4 ayes.

First Reading of Ordinance MC21-60, An Ordinance Establishing the Licensing and Regulation of Medical Cannabis Dispensaries in Minnehaha County.  The number of licenses to be issued in the unincorporated areas of Minnehaha County was highly debated between the commissioners. The consensus of the commissioners that were present, was that only one license be issued. Discussions were also held on setting the application, license and renewal fees. There were no proponents for the ordinance.  Opponents of the ordinance that spoke were Sarah Koob, Sioux Falls, SD, Bill Hoskins, alderman for the City of Garretson, and Matt Jorgeson, CEO of Cannabis Chem Labs. MOTION by Barth, seconded by Heiberger, to set the date for Second Reading of the Ordinance for September 28, 2021. 4 ayes.

BREIFING

Kris Swanson, Treasurer, introduced Dr. Daniel Tracy, professor at the USD Beacom School of Business.  Dr. Tracy was hired as an independent consultant to analyze and recommend suggestions on how to improve the productivity of the Treasurer’s Office.  Dr. Tracy recommendations included updated technology, staffing issues, and layout of the office. The Commission decided further discussions are needed to address all of Dr. Tracy’s recommendations. 

Karsky passed the gavel to Heiberger at 10:02 am. Heiberger passed Karsky rejoined the meeting at 10:05 am.

Upon the request of Ben Kyte, Auditor, MOTION by Barth, seconded by Beninga to certify the results of the August 17, 2021 election for the Evergreen Acres Road District. By roll call vote. 4 ayes.

Upon the request of Ben Kyte, Auditor, MOTION by Heiberger, seconded by Barth to issue Order of Incorporation for Evergreen Acres Road District. By roll call vote. 4 ayes.

Upon the request of Ben Kyte, Auditor, MOTION by Heiberger, seconded by Barth, to approve Resolution MC21-51. By roll call vote. 4 ayes.

RESOLUTION MC 21-50

RESOLUTION TO ESTABLISH BOUNDARIES OF

MEADOW VIEW CIRCLE ROAD DISTRICT

WHEREAS the Minnehaha County Commission has received the petition for formation of the Meadow View Circle Road District

IT IS HEREBY RESOLVED AND ORDERED by Minnehaha County Board of Commissioners, that the territory, in the Hanson Meadow Addition, lots 1 through 8, in the Northwest Quarter (NW ¼) of Section 28, Township 103 North, Range 50 West of the 5th Principal Meridian, Minnehaha County, South Dakota, according to the recorded plats thereof is hereby established as the boundaries of the Meadow View Circle Road District. The preceding is identified in the map attached to the Application for Incorporation of the Meadow View Circle Road District and shall, with the assents of the voters, as specified in SDCL 6-16-2, in an election as provided in SDCL 6-16-4 to SDCL 6-16-6 inclusive, be in an incorporated district by the name of Meadow View Circle Road District.

AGREEMENT

MOTION by Heiberger, seconded by Barth, to declare a copier at the Defense Attorney Counsel Room as surplus and authorize disposal at the local Electronic Waste Recycling Center.  By roll call vote: 4 ayes.  

MOTION by Heiberger, seconded by Barth, to declare a Museum Department Vehicle as surplus and authorize disposal by auction. By roll call vote: 4 ayes.  

Liaison report from Bill Hoskins, Minnehaha County Museum Director Mr. Hoskins Provided an update of endowment balance from the Sioux Falls Area Foundation.

PERMITS

MOTION by Heiberger, seconded by Barth, to approve and authorize the chair to sign a request from Mike Denning to display fireworks at Huset’s Speedway on September 12, 2021. 4 ayes.

MOTION by Barth, seconded by Beninga, to approve and authorize the chair to sign a request from Mike Denning to display fireworks at Laurel Ridge Barn on September 11, 2021. 4 ayes.

SURPLUS

Upon the request of Tyler Klatt, Assistant Commission Officer, MOTION by Beninga, and seconded by Heiberger, to authorize the sale of county owned property at 1900 West Russell Street by public auction with a minimum bid of $1,000,000.  4 ayes.

Commissioner Barth left the meeting at 11:04 am.

AGREEMENTS

MOTION by Heiberger, seconded by Beninga, to authorize chair to sign a lease agreement with Carstensen Contracting to utilize vacant county property for construction staging. 3 ayes. 

MOTION by Heiberger, seconded by Beninga, to adopt the first, third, and fourth Tuesday’s of each month as regularly scheduled meetings for the Minnehaha County Board of Commissioners. 3 ayes.

Commissioner Barth returned to the meeting at 11:07 am. 

HEARING

Ben Kyte, presented the Budget Hearing for FY2022 Minnehaha County Budget and adjustments to the Provisional Budget approved by the Commission on July 27, 2021. General Fund adjustments were as follows: centrally assessed utility values increased taxes by $3,700, STI security contract revenue increased Sheriff Department revenue by $119,000, and appropriations were increased $30,000 for salary and benefit changes for personnel actions approved since provisional budget was adopted. Highway Fund adjustment included appropriations decreased by $14,800 for benefit changes for personnel actions since provisional budget was adopted. Building Fund adjustments included centrally assessed utility values increased taxes by $300 and appropriations were increased by $125,000 for parking lot improvements. General Fund Cash applied of $6,813.644 in under the 8% goal after one-time items, as that percentage as a maximum has worked well as an estimated number.  The Commission will adopt the final FY2022 budget on September 28, 2021.

LIAISON REPORTS

Commissioner Heiberger noted that the South Dakota Association of County Commissioners Annual meeting will be held September 13-14, 2021 in Rapid City.   

Commissioner Karsky met with Bill Early, Director, The Link and Steve Groen, Highway Superintendent.
