Sealed bids for the Construction of  the Brandon Valley High School Classroom Addition in Brandon, South Dakota,  will be received by Jarod Larson, Superintendent of Schools, Brandon Valley School District, at the Brandon Valley School District Administration Center Conference Room, located at 300 South Splitrock Boulevard, Brandon, South Dakota until 2:00 p.m. prevailing time on Thursday, February 10, 2022. The bids will be opened and read aloud.

A single combined bid will be received in accordance with the Construction Documents prepared by Architecture Incorporated, dated January 7, 2022.  All bidders shall take note of the AIA Document A701 “Instruction to Bidders”, the AIA Document A201 “General Conditions of the Contract for Construction”, and the Supplementary Conditions which are a part of the Construction Documents.

Plans and Specifications will be made available to all Prime Bidders and major subcontractors through CADD Engineering Supply (CES), located at 615 South Lyons Avenue, Suite 100, Sioux Falls, South Dakota; Prime Bidders and major subcontractors should contact Derek Gors at (605) 332-2550 or print@cescolor.com.  Copies of the Plans and Specifications shall require a deposit of $150 each.  Deposits shall be made payable to Architecture Incorporated. Plans and Specifications may be examined at the office of the architect, Architecture Incorporated, 415 South Main Ave., Sioux Falls, South Dakota, with the Owner at the Brandon Valley School District Administration Offices, 300 South Splitrock Boulevard, Brandon, South Dakota.

Addenda will be uploaded to the Architecture Incorporated website at www.architectureinc.com under the ‘Projects Out for Bid’ section as they are issued.  All bidders are encouraged to check the website regularly for the most current addendum information.

Each bidder must deposit bid security with the bid.  Such security shall be based upon the amount of the base bid and shall consist of a Bid Bond for ten percent (10%) of the amount or a certified check, cashiers check or draft in the amount of five percent (5%) of the base bid and drawn on a State or National Bank.  Such Bid Bond shall be issued by a surety authorized to do business in the state of South Dakota and payable to the Owner.  The Bid Bond shall guarantee the execution of the contract by the successful bidder and shall be held by the Owner until said contract is executed.  

No bidder may withdraw a bid for 30 days following the bid opening without a written request explaining the cause of the withdrawal and without written consent of the Owner after reviewing the cause.

The Owner reserves the right to reject any and all bids or parts hereof, and to waive any irregularities of any bid.  The Owner also reserves the right to award the Contract to the lowest responsible bidder as may be determined by the Owner.

Brandon Core Area Reconstruction Phase 2

CALL TO ORDER

The Commissioners of the City of Valley Springs met in regular session on Tuesday, January 11th, 2022 at 6:00pm in the VS American Legion. Mayor Carl Moss presided. Answering roll call were Commissioners Dean Helgeson, Brian Staeffler, Lynn Schmitt and Sandy Severtson. Also present was Finance Officer Samantha Boyer, Public Works Director Blaine Eilts, City Attorney Patrick Glover. Motion by Helgeson to approve the January 11th, 2022 Posted Agenda. Staeffler seconded the motion. Motion carried, all voted aye.

APPROVAL OF AGENDA

Motion by Helgeson to approve agenda. Staeffler seconded the motion. Motion carried, all voting aye.

APPROVAL OF MINUTES NOVEMBER 29TH, DECEMBER 15TH & 27TH, 2021 AND JANUARY 4, 2022 MINUTES

Motion by Staeffler to approve November 29th, December 15th & 27th, 2021 and January 4th, 2022 minutes. Schmitt seconded the motion. Motion carried, all voting aye.

APPROVAL OF DECEMBER CLAIMS AND PAYROLL

Motion by Helgeson to approve the December 2021 claims in the amount of $445,914.77. Severtson seconded the motion. Motion carried, all voting aye. No payroll was presented.

APPROVAL OF CASH REPORT

Motion by Staeffler to approve cash report. Schmitt seconded the motion. Motion carried, all voting aye.

PUBLIC COMMENT

On the Rocks asked about having a band for Booster Days. The Community Club will be contacted.

It is confirmed Automania will be in Valley Springs this year on June 28, 2022.

A resident had a question about the December water bills. The city had a glitch in our water billing system, sent out letter to the customers it affected on 1/10/2022. New water bills were sent out on 1/11/2022. 

Fence issues are still coming up, with the large amounts of rain we recently got, a basement was almost flooded because of the fence. Residents want to cut about 6 inches off of the bottom of the fence to allow water to flow instead of getting caught up by the fence. The Mayor will try to call her to fix this on-going problem.

Brandon Valley Baseball Association doesn’t have enough fields for kids to play baseball this summer. They asked if they could add another field. It would be a small field with no back fence- north of the big field at Legion Park. There will still be the soccer area. Stuart asked if we would be able to help them with any of the costs or help with Agrilime. Motion by Helgeson to approve a truck load of Agrilime for the new field. Staeffler seconded the motion. Motion carried, all voting aye.

Motion by Staeffler to approve additional baseball field. Schmitt seconded the motion. Motion carried, all voting aye.

Sidewalk on Dunham needs to be brought up about 6 inches on both sides of railroad. We will have our City Engineer look at it.

CITY ENGINEER REPORT

Called City Engineer, Gabe Labor put him on speaker phone, gave us an update on the streets & utilities improvement project. Net deduct change order request #2 for $5,847.21. A motion was made by Staeffler to approve. Helgeson seconded the motion. All voting yes, motion carried. A motion was made by Helgeson to approve pay request to ASCO in the amount of $92,128.08 and Severtson seconded the motion. All voting yes. Motion carried.

(a) 2022 Humane Society Contract- Motion by Severtson to approve the contract. Staeffler seconded the motion. Motion carried, all voting aye.

(b) 2022 Med Star Agreement- Motion by Staeffler to approve Med Star Agreement. Helgeson seconded the motion. Motion carried, all voting aye.

PUBLIC WORKS REPORT

Maintenance Employee Blaine Eilts presented his monthly report. Items included: 

Blaine asked if an $800 subscription is needed for the radar signs, they will still function, just won’t be able to access traffic data. The council agreed it was not necessary.

The Minnehaha County Sheriff’s Office asked for the amount on a fine on illegal burning happening in the city. $200 fee per incident was the amount agreed upon. A letter will be sent about burning and debris removal.

Trees in the right-of-way on Cliff Avenue to be moved. A letter will be sent to the business and they have until May 1st, 2022 to move the trees.

Blaine asked about purchasing a boom for his sprayer for $650.00. The board agreed.

Blaine asked for approval to apply for a grant to get two new weather sirens. Blaine was told to apply for the grant.

Banyon Payroll module was approved. Was purchased. 

CITY ATTORNEY REPORT

Gave an update on Medical Cannabis.

The next regular meeting of the Valley Springs City Commission will be February 8th, 2022 at 6:00pm in the Valley Springs American Legion, 615 Broadway Avenue.

PUBLIC HEARING 

Kevin Hoekman, Planner, was present for the scheduled hearing on a complaint on the property legally described as E 1/4 NE 1/4 (Ex. Coverts Addn.) Section 11-T102N-R52W, Humboldt Township, Public Nuisance and Enact SDCL 21-10-06. The County Commission held an initial hearing on October 19,2021. The hearing was continued to December 21, 2021, and continued again to January 18, 2022. Kevin Hoekman informed the Commission that when he visited the property on January 11, 2022, he found a majority of the vehicles had been removed and the silo has been loaded for removal. Following input from the property owner and discussion by the Commission, no action was taken.

PUBLISH REQUEST FOR PROPOSALS 

Upon request of Tyler Klatt, Assistant Commission Administrative Officer, MOTION by Barth, seconded by Karsky, to authorize Auditor to publish Request for Proposals (RFP) for architect and engineer services for the Juvenile Detention Center project. 5 ayes.

LEGISLATIVE UPDATE

Tyler Klatt, Assistant Commission Administrative Officer, gave a briefing on the 2022 Legislative bills that impact Minnehaha County specifically highlighting House Bills (HB) 1011, 1033, 1038, 1039, 1045, and 1053 as well as Senate Bills (SB) 3, 25, 40, 53, 62, 63, 64, and 69. HB 1011 would revise the application process for the reduction of tax on dwellings owned by paraplegics. HB 1033 would expand the eligible projects for the local infrastructure improvement grant fund and this legislation is part of the Sioux Falls-Minnehaha County joint legislative priorities and/or the SD Association of County Commissioners resolutions. HB 1038 would establish an opioid trust fund and to declare an emergency. The Commission approved the Auditor registering Minnehaha County for the National Opioid Settlement on November 16, 2021. HB 1039 provides for the assessment of certain agricultural land as noncropland. This would apply contingent on the land being at a minimum of 1,950 ft above sea level-County GIS confirmed that 1,800 ft is the highest point in Minnehaha County. HB 1045 would increase a tax on the gross receipts of all sales of marijuana, and to distribute a portion of that revenue to counties. HB 1053 would authorize counties to issue bonds for certain expenditures funded by a gross receipts tax. This legislation is part of the Sioux Falls-Minnehaha County joint legislative priorities and/or the SD Association of County Commissioners resolutions. SB 3 would provide for the use and regulated sale of marijuana. SB 25 would provide for the taxation of marijuana. SB 40 would establish safety standards regarding biogas gathering lines. SB 53 would make an appropriation to increase workforce housing and to declare an emergency. This legislation is part of the Sioux Falls-Minnehaha County joint legislative priorities and/or the SD Association of County Commissioners resolutions. SB 62 would make an appropriation for eligible water, wastewater, storm water, and nonpoint source projects and to declare an emergency. This legislation is part of the Sioux Falls-Minnehaha County joint legislative priorities and/or the SD Association of County Commissioners resolutions. SB 63 would revise the appropriation for road improvements to the State Veterans Cemetery, to provide for ordinary operations of the cemetery, and to declare an emergency. SB 64 would make appropriations from the water and environmental fund and its revolving fund subfunds for various water and environmental purposes and to declare an emergency. SB 69 to provide for an electronic system to update voter registration information.

RESOLUTION MINNEHAHA COUNTY 22-11

A RESOLUTION TO AUTHORIZE A TASK FORCE FOR THE PURPOSE OF REVIEWING AND ESTABLISHING A VISION FOR THE WILLIAM H. LYON FAIR GROUNDS

WHEREAS, in 1938 Winona Axtell Lyon made a gift of certain real estate to Minnehaha County in commemoration of her deceased husband William H. Lyon and that such gift was to be thereafter designated as the William H. Lyon Fair Grounds;

WHEREAS, in 1942 Winona Axtell Lyon made a further gift of additional real estate to Minnehaha County in commemoration of her deceased husband William H. Lyon as an expansion of the William H. Lyon Fair Grounds;

WHEREAS, the William H. Lyon Fair Grounds is the site of the Sioux Empire Fair, 4-H Achievement Days, Sioux Empire Livestock Show, sporting events, community events, horse shows and rodeos;

WHEREAS, 600,000 people attend an event at the Fair Grounds each year;

WHEREAS, the Minnehaha County Board of Commissioners seeks to focus future county investments, community support and donor gifts, both for facilities and general operating support, to best meet the needs of the community and the intent of the Lyon’s gift;

WHEREAS, the Minnehaha County Board of Commissioners seeks to identify diverse community stakeholders with no identifiable conflict of interest who are willing to invest time into this important strategic planning process related to the Fair Grounds, including a review of existing facilities, financials, events and opportunities.  

WHEREAS, the Minnehaha County Board of Commissioners seeks to honor the wishes of Winona Axtell Lyon, recognize the community support for the activities at the Fair Grounds; and desires to envision a Fair Grounds that meets the evolving needs of stakeholders, including exhibitors, participants, attendees, and sponsors of all such events both now and in the future;

THEREFORE BE IT RESOLVED BY THE MINNEHAHA COUNTY BOARD OF COMMISSIONERS that a task force be established to review and establish a vision for the William H. Lyon Fair Grounds

Jon Carroll, Fair Board Member, spoke about how excited he was to see a future for the fairgrounds and not the fate.

Steve Munk, Dell Rapids, stated that the creation of the task force would was positive item for the fairgrounds and it was good to see the Commissioner take the lead on this project.

Commissioner Beninga commented that the Task Force will work towards the creation of a vision that is responsive to both the Community and the Lyons family.  Commissioner Bender commented that this provides an opportunity to think hard about the projects and have all of the stakeholders at the table.  Commissioner Barth stated that this will allow the public to see where the funds are going and find ways to make things better. Commissioner Karsky commented that he has received numerous positive comments about the creation of the task force. Commissioner Heiberger suggested that the details of the  task force be put on a future agenda for more in depth discussion around the budget and application submittal.

Commissioner Karsky reported on the attendance at the National Association of County Commission meeting held in Washington D.C. and the in depth briefing that was given regarding the American Rescue Plan Acts funds.

For a response to the Request for Proposals to be considered, any response must be received by the Minnehaha County Auditor’s Office, 415 N. Dakota Avenue, Sioux Falls, South Dakota 57104 no later than February 15th, 2022 at 2:00 p.m. central time. Instructions are contained in the Request for Proposals which shall be carefully followed by Proposers. Two (2) hard copies and three (3) electronic copies of the complete response to the Request for Proposals are to be submitted. Responses to the Request for Proposal received after the submission deadline will be rejected and returned unopened to the sender. 

The Request for Proposal for A/E services has been placed on file at the Minnehaha County Auditor’s Office. The RFP is also available under the Notices section of the Minnehaha County Website, https://www.minnehahacounty.org. The County reserves the right at any time and for any reason to cancel this Request for Proposals, to reject any or all proposals, to provide an addendum to this Request for Proposals, or to accept an alternate proposal. The County reserves the right to waive any immaterial defect in any response to the Request for Proposal.

MC22-11 Scrub Seal

PROJECT DESCRIPTION 

This project consists of scrub sealing 61,540 square yards of parking lot. This project will also include fog seal and new striping. 

Sealed bids shall be received by Minnehaha County Auditor’s Office, 415 N Dakota Avenue, Sioux Falls, SD  57104, not later than 10:15 a.m. Wednesday, February 9, 2022. Bids shall be publicly opened and read at the Auditor’s Office at 10:30am.

Specifications and proposal forms that must be used are available at Minnehaha County Highway Department located at 2124 E 60th Street North, Sioux Falls, SD  57103. Bids submitted on forms other than the proposal supplied by the Minnehaha County Highway Department will be irregular and will not be considered.

Minnehaha County reserves the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of the County.
