The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 24th of January 2022 at the Brandon Valley High School Community Room with the following members present:  Renee Ullom, Gregg Ode, Gregg Talcott, Nick Scott.  Absent: Ellie Saxer.  Also present were Superintendent Jarod Larson, Business Manager Paul Lundberg, High School Principal Mark Schlekeway, Activities Director Bill Freking, Middle School Principal Brad Thorson, Intermediate School Principal Nick Skibsted, Valley Springs/Inspiration Elementary Principal Tanya Palmer, Brandon Elementary Principal Merle Horst, Robert Bennis Elementary Principal Kristin Hofkamp, Director of Instruction Sherri Nelson, and Operations Manager Ty Hentschel.

Renee Ullom called the regular meeting to order at 6:30 p.m.  In memory of Chad Garrow, long-time teacher and coach with the Brandon Valley School District, who passed away on January 21, 2022, the board recognized him with a moment of silence at the beginning of the meeting followed by the Pledge of Allegiance.

Motion by Scott, seconded by Talcott to approve the agenda as presented.  Motion carried.

At tonight’s meeting, the Good News Report was an overview of the Brandon Valley Fine Arts Night scheduled at BVIS and RBE on Thursday March 24, 2022.  Art Instructors Jordan Heeren, Heidi McNamara, and Erin Rieff discussed this event that builds community involvement, connections with others and provide a venue for students’ work to be seen by a larger community of people.  With over 600 community members expected to attend with 65 volunteers, this night is going to be a BIG event.  All patrons are encouraged and invited to attend!

Administrative reports were presented.   Superintendent Jarod Larson reported on the following:

The COVID-19 Information Website: https://brandonvalley.k12.sd.us/covid/covid.html is the centralized communication hub.   THE MESSAGE:  If you are sick – stay home!  COVID-19 vaccination available for children ages  5-11.  Larson encouraged families to communicate with their primary care provider and make the right personal choice for their situation.

A future federal requirement for School Bus Drivers will be an entry level driver training program.  This formalizes our current training procedure and also requires submission of documentation.  This requirement is effective February 7, 2022, with all licensed drivers prior to that date grandfathered into the program.  At tonight’s BOE meeting, we will review and approve Entry-Level Driver Trainer (ELDT) Wage/Training position(s).

Brandon Elementary/Core Area Drainage Improvements:

° Convey small piece of unusable property to City of Brandon

° SE corner of Brandon Elementary Land (South of field/track area)

° Component of large-scale drainage improvements

° Formal Agreement provided at future meeting

BV Listens 2.0!  The BV School District has disseminated a work environment survey to staff (for both certified and classified staff) with a January 18, 2022 deadline.  This survey is now closed.  This aligns with our Strategic Plan for staff development to support highly effective teachers, leaders and staff. Results to follow.

The 2022-23 Budget process has begun with budget forms/documents distributed early January, 2022.  The Business Office will compile and review by March 2022.  In February 2022, we will present the 5-year plan along with new staffing positions.  In March 2022, the preliminary Capital Outlay budget will be presented for approval in order for major items to be bid in a timely manner.  In May 2022, we will hold a preliminary budget presentation and in July 2022, we will hold the public budget hearing for potential action.

A School Board Election for two (2), three-year (3-year) seats will be held on Tuesday, June 21, 2022 (if necessary).  The earliest date to circulate a petition is April 7, 2022; the deadline for return of petitions is May 13, 2022 (candidates must file a Financial Interest Statement within 15 days of filing a nominating petition.)  If you have any further questions regarding this process, please contact the Business Office. 

Tentative 2022-23 negotiations timeline/wage recommendations will begin with a pre-negotiation meeting between the BVSD Admin and the Brandon Valley Education Association (BVEA) sometime in March.  The Personnel Welfare and BVEA plan to meet on March 22, 2022 with a scheduled BOE Executive Session for negotiations preparations on March 28, 2022.  A Personnel Welfare/BVEA Negotiations meeting is then scheduled for March 30, 2022 (with additional dates scheduled thereafter, if necessary).  Tentatively, at the April 11, 2022 Board of Education regular meeting we will plan to ratify the 2022-23 Master Contract, approve Classified wage recommendation/approve Administration Salary recommendations, and enter Superintendent contract negotiations.

Legislative Session Update:  Joint Associated School Boards of South Dakota (ASBSD)/School Administrators of South Dakota (SASD)/Large School Group Information Resources are available on their web-site.

Current School Calendar items include the following: Friday, February 18, 2022-No school; Monday, February 21, 2022-No school (President’s Day); Monday, March 14, 2022-Elementary/BVHS Parent-Teacher Conferences; Tuesday, March 15, 2022-Intermediate/Middle School Parent-Teacher Conferences; Thursday, March 17, 2022-School in session (make up snow day); Friday, March 18, 2022-No school (comp day); and Friday, April 1, 2022-No school (in-service).

The BVHS Addition priorities include General Classrooms, Ground Floor Special Education, Science Lab Classrooms, Maximize Land Usage/ Upgrade East Facility Face, all while minimizing the impact to parking.

Superintendent Jarod Larson reported on the proposed 2022-23 school year calendar.  This calendar has been through a review with the Administration, Teacher Liaison Committee, and the Classified Council and is consistent and corresponding to the previous year school year calendar.  Important dates to highlight are August 16, 2022 as new staff in-service, August 18, 22, and 23, 2022 with all staff returning.  Wednesday, August 24, 2022 is the scheduled first day of classes and Thursday, May 25, 2023 as the last day of classes for all BV students.  Brandon Valley High School graduation is schedule for Sunday, May 14, 2023.  Motion by Talcott, seconded by Scott to approve the Proposed 2022-23 school year calendar as presented.  Motion carried.

Superintendent Larson reviewed the Real Estate Purchase Agreement by and between the Brandon Valley School District (seller) and the City of Brandon, South Dakota (buyer), for approximately 2.05 acres (plat of Lots 1 and 2 of Block 1, Brandon Elementary School Addition), for $1.00 as presented.  This agreement conveys a small piece of unusable property on the SE corner of Brandon Elementary (south of field/track area) for large-scale drainage improvements in the core area as outlined.  Motion by Ode, seconded by Talcott to approve this Real Estate Agreement as presented.  Motion carried.

Motion by Talcott, seconded by Scott to approve the following general business items:

1. Approve corrective action letter regarding Child Nutrition Services overage of funds in net cash reserves, $740,400.00, as presented.

2. Approve Brandon Valley High School Intent to Participate in Girls Team Softball as a school sponsored sport, effective to begin with the spring of the 2022-23 school year, as presented.

3. Approve recommendation to purchase supplemental ELL Curriculum and Technology in the amount of $60,774.17 with ESSERII Funds, to overcome learning loss and enhance ELL support within the program, as presented.

4. Deny BVSD Petition for a Residency Exception (#22-003), effective for the 2021-22 school year.

Motion carried.

Motion by Scott, seconded by Ode to approve the following personnel items:

1. Approve recommendation to hire Brenda Burch, long-term substitute for Shalena Zeller, BVIS 5th Grade English/Language Arts Teacher, effective January 10, 2022 for approximately 8 weeks. 

2. Approve request for leave without pay by Jolene Roozenboom, VSE Educational Assistant on Friday, March 4, 2022 for one day.

3. Approve recommendation to hire Jeff O’Connell, Assistant BVHS Track and Field Coach, 8.5% of Extra-curricular Step 5 ~ $3,594.00, effective for the 2021-22 school year.  (This amount will be paid less current MS track position amount of $2,667.00 resulting in a net addition of pay of $927.00.)

4. Approve recommendation to hire Teresa East, part-time BVIS Child Nutrition worker ~ $14.75/hour, effective January 26, 2022. 

5. Approve recommendation of Entry Level Driver Trainer (ELDT) wage of $20.00/hour, for the program that begins February 1, 2022, as presented.

6. Approve resignation/retirement of Lynn Bartscher, BVHS Administrative Assistant, effective June 10, 2022.

7. Approve leave without pay for Erin Ashby, BVHS Child Nutrition, for approximately 8-12 days, effective during the 2021-22 school year as presented.

8. Approve mid-year lane changes for the 2021-22 school year as follows:  Dan Canfield: MA to MA+15 and Kimberly Skibsted: MA+15 to MA+30.

The following personnel items were reviewed by the Board of Education for information only:

1. Transfer Megan Dieren from Elementary Distance Learning Academy Teacher to Robert Bennis Elementary 2nd Grade Teacher, effective for the 2022-23 school year.

Communication received by the Central Office and Board of Education were reviewed.  They included the following item:

1. Thank you from Debra Rothenberger for sponsoring the Brandon Valley Retired Staff Holiday Luncheon.

Board reports were presented.  Board Member Nick Scott reported on a recent Transportation Committee.  The meeting included the following highlights: 1) Forecasting into the next five years dealing with the construction and the challenges that will be faced with that growth.  2) Discussed the purchase of additional vehicles, including purchasing three new busses that will be fueled with propane.  The Committee has been reviewing a study highlighting this new option and have also talked with area school districts that are using this option.  With that study information and recommendations that have been reviewed, BV is going to try out three new propane fueled busses.  3)  Lastly, Scott believes that the Entry-Level Driver Trainer (ELDT) program is a positive direction for this department.

Board President Renee Ullom reported on the Alternative Education Committee.  Teachwell Academy has been branching out and has some exciting new challenges in the future.

Board Member Gregg Talcott reported on a recent Safety Committee.  Talcott thanked Resource Officer Tyler Carda’s insight and stated that this is an very valuable bridge that the school district has built between the City and the School District.  Talcott stated that there is a lot of thought that is going on behind the scenes to protect our students and he is very thankful for that.  Scott also thanked our staff.  He has heard many times that BV students overwhelming have stated that they feel safe and valued talking to the Brandon Valley Staff.  The School Board, and Scott personally, is thankful the connections that have been built between students and staff.

The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, January 13, 2022, at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Barb Fish, Tim Jorgenson, David Kull, Jack Parliament and Mayor Jim Heinitz.  Other’s present were City Administrator, Bryan H Read; Finance Officer, Christina Smith; City Engineer, Tami Jansma; Public Works Director, Rollie Hoeke; Police Chief, Jamie Steffel; Fire Chief, Robert Dykstra and Park Superintendent, Devin Coughlin.  Absent: Vickie David.

CANNABIS LICENSE LOTTERY

Five applications were received for dispensaries, and three applications were received for cultivation.  Lottery system will be used for the dispensaries.  Mayor Heinitz drew letters, which were assigned to each sealed application, to select applications for the three available dispensary licenses, with 4 & 5 in line in case one of the three is unable to obtain the necessary licensing requirements.

HENKEL REQUEST OR SALES TAX REBATE

Jesse Fonkert, President/CEO of Sioux Metro Growth Alliance, was present for discussion.  Jesse introduce Bruce Leir, Director of Operations for Henkel Corporation.  Henkel Corporation is requesting that the 2% local sales tax be forgiven over a 24 month period for equipment costs starting July 1, 2021.  Alderwoman Fish moved Alderwoman David seconded to approve the sales tax rebate on equipment, capped at $260,000.00, as presented, and directed staff to write up an agreement.  Motion carried.

PURCHASE TRAP RAKE

The Golf Course Committee report was heard.  Alderwoman Clark moved Alderman Parliament seconded to authorize the purchase of a Sand Pro 5040 Trap Rake from Midwest Turf & Irrigation for $28,411.00.  Motion carried.

HIRE SUMMER RECREATION DIRECTOR

The Parks & Recreation Committee report was heard.  Alderman Fish moved Alderwoman Clark seconded to approve the hiring of Barb Sperlich as Summer Recreation Director, at $13.50 per hour with $400.00 manager bonus, effective January 18, 2022.  Motion carried.

YEAR-END BUILDING PERMIT REPORT

The Public Safety Committee report was heard.  The year-end building permit totals were presented.  No action required.

POLICE STUDENT INTERN

Alderwoman Clark moved Alderman Kull seconded to approve the internship between the Brandon Police Department and Harrisburg High School, and to approve Madison Ziebarth as an unpaid volunteer with the Brandon Police Department for the spring semester of 2022.  Motion carried. 

VFW RAFFLE

The Administration Committee report was heard. It was the consensus of the Council to allow the VFW Post 4726 to proceed with their raffle, as presented.  No further action required.

Alderwoman Fish moved Alderman Jorgenson seconded to approve Resolution #08-22.

An appeal was received of the January 6, 2022 decision of the Planning & Zoning Commission for the Conditional Use Application at 704 S. 8th Avenue.  City Ordinance requires the City Council be made aware that the appeal was received.  A public hearing will be held, to consider the appeal, at the City Council meeting on February 7, 2022.

Alderman Kull moved Alderwoman Clark seconded to approve pay application #8 to AB Contracting for the water tower project, in the amount of $476,723.37.  Motion carried.

Minnehaha County, South Dakota, hereby solicits qualified and interested parties to submit responses to the Request for Proposals for providing Construction Manager-at-Risk (CMAR) services, as described in the Request for Proposals, in accordance with federal, state, and local laws and regulations. The County Commission is seeking responses to the Request for Proposals to provide CMAR services for the Minnehaha County Juvenile Detention Center design and construction.

For a response to the Request for Proposals to be considered, any response must be received by the Minnehaha County Auditor’s Office, 415 N. Dakota Avenue, Sioux Falls, South Dakota 57104 no later than February 22, 2022 at 2:00 p.m. central time. Instructions are contained in the Request for Proposals which shall be carefully followed by Proposers. Two (2) hard copies and three (3) electronic copies of the complete response to the Request for Proposals are to be submitted. Responses to the Request for Proposal received after the submission deadline will be rejected and returned unopened to the sender. 

The Request for Proposal for CMAR services has been placed on file at the Minnehaha County Auditor’s Office. The RFP is also available under the Notices section of the Minnehaha County Website, https://www.minnehahacounty.org. PROJECT NAME Minnehaha County Administration Building

PROJECT DESCRIPTION Abatement and disposal of materials identified in GeoTek report dated 9/16/2020. Asbestos abatement will take place in areas effected by extents of demolition on 2nd and 3rd floor of the Minnehaha County Administration Building per demolition drawings A101 and A102.

PRE-BID CONFERENCE A Pre-Bid Site Visit will be held at 415 North Dakota Avenue at 1:30 PM on January 31st, 2022 for the purpose of providing bidders and opportunity to review the existing building and ask any questions. Attendance is strongly recommended. No other Pre-Bid conference will be held.

BIDDING DOCUMENTS Bidding Documents are available at the Henry Carlson Construction’s Plan Room located at 1205 West Russell St – Sioux Falls, SD 57104. BID PROPOSAL Use the Bid Form in Section 00-07

BID DATE AND TIME Bids will be received until 10:00 A.M. on 2/11/2022 at the Auditor’s Office in the Administration Building. The bids will then be publicly opened at 10:15 a.m. in the multipurpose Room on 2nd Floor.

Bid envelopes shall be marked on the outside lower left corner “Bid Proposal for Asbestos

Abatement.” Full responsibility for the delivery of mailed bids before the deadline for receiving

bids rests with the bidder.

All bids must be accompanied by a Cashier’s Check or Bid Bond payable to Minnehaha county, In an amount equal to five percent (5%) of the total amount of all submitted bids, if a cashier’s check or an amount equal to the percent (10%) of the total amount of all submitted bids if a bid bond.

 LENGTH OF VALIDITY OF BID All Bids shall be valid for acceptance by the Owner for a period of Sixty (60) days after submission of the Bid(s).

INTERPRETATION AND ADDENDA Requests for interpretations, clarifications, corrections or changes of the Bidding Documents must be made in writing by email or fax at least Four (4) calendar days (February 7th, 2022 by 3:00 PM) prior to the date for receipt of Bids. No Addenda will be issued later than Two (2) business days prior to the date for receipt of Bids for the limited situations set forth in the Instructions to Bidders.

MBE/WBE GOALS MBE/WBE goals are not required on this Project. However, it is requested that Bidders actively solicit minority contractors, suppliers and their organizations.

AMERICAN RESCUE PLAN FUNDING

   Susan Beaman, Finance & Budget Officer, gave a briefing on the American Rescue Plan Act (ARPA) Final Rule. The final rule was issued on January 6, 2022, and will be effective on April 1, 2022, but Minnehaha County is allowed to take advantage of the final rule’s flexibilities and simplifications now even ahead of the effective date. The final rule includes a number of key changes, confirmations, and clarifications including the following: replacing lost revenue, responding to the public health emergency, responding to negative economic impacts, public sector capacity, capital expenditure, and water & sewer infrastructure. The final rule reinforces the restrictions on use of the funding as well as the need to comply with the uniform administrative and reporting requirements. The Auditor’s Office recommends that the Commission discuss a timeline for a decision on the use of the ARPA funds which will allow us to maximize the capture of the allowable expenses and to ensure compliance with all funding requirements. It is also the Auditor’s Office recommendation that the Commission consider the amount for internal County uses that will provide General Fund relief vs. the amount set aside for external project requests. Staff from the Auditor’s Office will return to a future meeting for additional dialogue.

PUBLISH REQUEST OF PROPOSALS

Upon request of Carol Muller, Commission Administrative Officer, MOTION by Barth, seconded by Bender, to authorize the Auditor to publish Request for Proposals (RFP), for Construction Manager-At-Risk services for the Juvenile Detention Center Project. 5 ayes.

LEGISLATIVE UPDATE

Carol Muller, Commission Administrative Officer, gave a briefing on the 2022 Legislative bills that impact Minnehaha County, specifically highlighting House Bills (HB) 1070, 1075, 1077, 1079, 1082, 1083, and 1087 as well as Senate Bills (SB) 85. HB 1070 would clarify certain provisions of the rural access infrastructure improvement grant programs. HB 1075 would modify legal and official notice publication requirements. HB 1077 would require certain language for the oath or affirmation for civil office. HB 1079 would revise provisions regarding court transcript costs. HB 1082 would revise the motor vehicle excise tax on vehicles leased for more than twenty-eight days to include certain off-road vehicles. HB 1083 would provide a partial property tax exemption for the surviving spouses of certain veterans. HB 1087 would revise certain provisions regarding records that are not open to inspection and copying. SB 85 create an act to create the ARPA water and environmental fund, create a subfund, to make an appropriation therefor, and to declare an emergency. 

FAIR GROUNDS TASK FORCE

Carol Muller, Commission Administrative Officer, provided a briefing regarding the application process for the W. H. Lyons Fair Grounds Task Force. A draft application was shared along with ways that the public will be informed that the application period is open. The application closing date is February 28, 2022, with Commissioners reviewing applications in March. In the immediate weeks to follow, information and requests will be presented regarding facilitation and budget. Dan Kippley, Sioux Falls, SD, spoke about the time commitment that might be required to serve on the task force. 

LAW ENFORCEMENT RETENTION BONUS

Carol Muller, Commission Administrative Officer, presented a request to consider a retention bonus for select law enforcement positions of Correctional Officers, Corrections System Operators, Deputy Sheriffs, and Juvenile Correctional Officers. The retention bonus is in recognition of the challenges in recruiting and retaining these essential staff. Under the program, new hires would be eligible to receive $1,000 at 9 months, 18 months, 27 months, and 36 months of service, with good performance. Retention bonuses are an allowable expense under ARPA (American Rescue Plan Act). 

If supported, any newly hired employee in select law positions would be eligible to receive the retention bonus on the milestone dates of service listed above. Any current employee reaching these milestone dates after April 15, 2022, would also receive the retention bonus. Current employees would not, however, receive retention bonuses for any milestones reached earlier than April 15, 2022. Anyone hired after December 31, 2022, will not be eligible for the retention bonus unless extended by the Minnehaha County Board of Commissioners. 

MOTION by Bender, seconded by Beninga, to authorize a retention bonus for qualifying law enforcement hires who reach anniversary dates after April 15, 2022. By roll call vote: 5 ayes.

EMPLOYEE PREMIUM PAY

Carol Muller, Commission Administrative Officer, presented a request to consider premium pay in recognition of Minnehaha County employees and the role they playing in providing essential services during the COVID Pandemic. Premium pay would be paid as follows: for the 24 months of service between March 2020 and February 2022 based upon employment status as of April 15, 2022. In recognition of the significant contribution of law enforcement employees, $100 per month of service for full-time employees in South Dakota Retirement Class B public safety eligible positions from March 2020 through February 2022. All other full-time employees would receive $75 per month of service. Variable hour or part-time staff would receive a prorated amount of the $75 per month based on the percentage of a full-time equivalent employee. Employees must be employed by Minnehaha County as of April 15, 2022, to receive the lump-sum payment. Elected officials would not receive premium pay. 

MOTION by Bender, seconded by Barth, to authorize premium pay for employees in recognition of their role in providing essential services during the COVID Pandemic. By roll call vote: 5 ayes. 

 LIAISON REPORTS

  Commissioner Barth spoke about the joint planning meeting held with the City of Sioux Falls and that several items were deferred and a building eligibility was transferred. 

Commissioner Heiberger spoke about working with a group to gather letters of support for the MacArthur grant and the deadlines related to the grant. 

Commissioner Karsky spoke about the Link annual meeting and review of the past year as well as ideas for the future. 

MOTION by Bender, seconded by Karsky, to adjourn. 5 ayes.

The Commission adjourned until 9:00 a.m. on Tuesday, February 1, 2022.
