The Brandon City Council met in regular session at 6:00 p.m. on May 3, 2021 in the Council Chambers at 308 S. Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull and Jack Parliament.  Others present were:  City Administrator, Bryan Read; Finance Officer, Christina Smith; City Attorney, Lisa Marso; City Engineer, Tami Jansma; Police Chief, Jamie Steffel; Golf Course Manager, Andrew Bauer and Public Works Director, Rollie Hoeke.
Council President Barb Fish chaired the meeting.
Alderwoman Clark moved Alderwoman David seconded to approve the agenda.  Motion carried.
Alderman Kull moved Alderman Jorgenson seconded to approve the minutes of the April 15, 2021 briefing meeting; the minutes of the April 19, 2021 regular meeting and the minutes of the April 19, 2021 canvassing board.  Motion carried.

CALL TO ORDER OF THE NEW COUNCIL
Council President Barb Fish called the new Council to order.  The Oath of Office was administered by Finance Officer Christina Smith to Alderman David Kull, Ward II.  Alderman Kull was presented with a Certificate of Election. 
Council members present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull and Jack Parliament.
Alderwoman Clark moved Alderman Parliament seconded to approve the agenda. Motion carried.
ELECTION OF COUNCIL PRESIDENT AND VICE PRESIDENT
Alderwoman David moved Alderman Parliament seconded to keep Alderwoman Fish as Council President and Alderwoman Clark as Vice President.  Motion carried.
DRAW FOR SEATING
It was the consensus of the Council to not draw for seating.
Heidi Jorgenson, 317 W. Hackberry Street, was present to publicly thank City Staff, City Council for getting everything ready for the Loyalty Day parade held May 2, 2021.  Heidi discussed her support for Chuck Parsons for the Mayor appointment and expressed her concerns with Jack Parliament not recusing himself from the vote for the Mayor appointment.  
TJ Cameron, 2821 E. Daybreak Circle, was present to thank everyone for the parade this past weekend.  TJ asked for City Council support for the Mayor appointment, and mentioned the polls done by the BV Journal that showed public support for him.
WATER CONSERVATION COMMITTEE
Kevin Smith, 521 E. Switch Grass Trai, was present representing the Water Conservation Committee.  Kevin gave updates on the Water Smarter Incentive Program.  Alderwoman Clark moved Alderwoman David seconded to approve the amendment to the Water Smarter Incentive Program to include high efficiency washing machines effective May 3, 2021.  Motion carried.
DRINKING WATER WEEK PROCLAMATION #2021-03
Council President Fish read Proclamation #2021-03 declaring May 2-8, 2021 as Drinking Water Week.  
Mayor’s Proclamation
WHEREAS, water is our most valuable natural resource; and
WHEREAS, only tap water delivers public health protection, fire protection, support for our economy and the quality of life we enjoy; and
WHEREAS, any measure of a successful society – low mortality rates, economic growth and diversity, productivity, and public safety – are in some way related to access to safe water; and
WHEREAS, we are all stewards of the water infrastructure upon which future generations depend; and
WHEREAS, each citizen of our city is called upon to help protect our source waters from pollution, to practice water conservation, and to get involved in local water issues by getting to know their water;
NOW, THEREFORE, be it resolved that by virtue of the authority vested in me as
Mayor of our City, I do hereby proclaim May 2-8, 2021 as Drinking Water Week.

MAYORAL APPOINTMENT
Alderman Kull moved Alderman Jorgenson seconded to appoint Chuck Parsons to fill the Mayor vacancy.  A roll call vote showed Fish, Jorgenson, Kull aye; Clark, David, Parliament aye.  Motion failed.
Alderwoman David moved Alderwoman Clark seconded to appoint Alderman Parliament to fill the Mayor vacancy.  A roll call vote showed Clark, David, Parliament aye; Fish, Jorgenson, Kull nay.  Motion failed.
Alderman Kull moved Alderwoman Clark seconded to reopen the Mayoral vacancy for additional applicants, stating the current 3 applicants do not need to reapply.  Applications would be due May 12, 2021, interviews done May 13, 2021 and appointment for May 17, 2021 regular City Council meeting.  A roll call vote showed Clark, David, Kull, Parliament aye; Fish, Jorgenson nay.  Motion carried.
GOLF COURSE SEASONAL STAFF
The Golf Course Committee report was heard.  Alderwoman Clark moved Alderwoman David seconded to approve the following 2021 seasonal staff for the Golf Course.  Motion carried.

Alderman Jorgenson moved Alderwoman David seconded to approve amendment #1 to IMEG for the Split Rock Creek bank stabilization contract in the amount not to exceed $25,000.00.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull aye; Parliament nay.  Motion carried.

The Parks & Recreation Committee report was heard.  Alderwoman Clark moved Alderwoman David seconded to approve the following 2021 pool staff pending lifeguard certifications.  Motion carried.

Alderwoman Clark moved Alderman Kull seconded to approve the new software for the pool at a cost of $11,362.50.  Motion carried.
POOL IMPROVEMENT PROJECT
Alderman Kull moved Alderman Jorgenson seconded to approve amendment #1 to TSP for the construction administration on the pool improvements project in an amount not to exceed $25,000.00.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull aye; Parliament nay.  Motion carried.
POOL IMPROVEMENTS PROJECT CHANGE ORDER
Pool improvements project change order #4 was presented.  Project was originally approved to not exceed $100,000.00.  The improvements are estimated at $68,4481.17, which is below the approved $100,000.00.  No motion needed, for informational purposes only.
POOL IMPROVEMENTS PROJECT – CHANGE ORDERS #8 & #9
Alderman Kull moved Alderman Jorgenson seconded to approve pay applications #8 & #9 in the amounts of $262,76.43 & $175,231.80, respectively, to Beck & Hofer Construction for the pool improvements project.  Motion carried.
VANBUSKIRK PARK FOOD TRUCK & ALCOHOL CONSUMPTION REQUEST
Alderwoman Clark moved Alderman Jorgenson seconded to approve the request from AJ Menden to have a food truck and alcohol consumption at VanBuskirk Park for a neighborhood gathering on August 27, 2021 from 5:00pm – 10:00pm.  AJ was present for discussion.  Everyone will be providing their own beverages and will be responsible for their own families consumption.  Motion carried.  
DONATION OF TRACT 6A BETHANY MEADOWS ADDITION
Alderwoman David moved Alderwoman Clark seconded to approve the acceptance of Tract 6A Bethany Meadows Addition to the City of Brandon and to approve the gifting agreement as presented.  Motion carried.
ASPEN PARK ROAD PROJECT
Alderwoman Clark moved Alderman Jorgenson seconded to approve the proposal from DGR for the construction administration for the Aspen Park Roadway and utility improvements project in the amount of $36,500.00.  Motion carried.
LIEUTENANT VACANCY
The Public Safety Committee report was heard.  Alderwoman Clark moved Alderwoman David seconded to approve the promotion of Sergeant Austin Peterson to Lieutenant, effective immediately, step 18-13 on the wage scale, $38.43 per hour.  Motion carried.
DEPOSITORIES
The Administration Committee report was heard.  Alderman Kull moved Alderwoman David seconded to approve the following depositories as presented:  First National Bank of Sioux Falls, Sioux Falls, South Dakota;  First National Bank in Sioux Falls, Brandon Branch, Brandon, South Dakota; Great Western Bank, Brandon Branch, Brandon, South Dakota; South Dakota Public Funds Investment Trust (FIT), Sioux Falls, South Dakota and Wells Fargo, Brandon Branch, Brandon, South Dakota.  Motion carried.
CITY OFFICIALS
Alderman Kull moved Alderwoman David seconded to approve the following appointment of City Officials for a 1 year term: City Attorney, Boyce Law Firm, L.L.P., Lisa Marso. Motion carried.
OFFICIAL NEWSPAPER
Alderman Kull moved Alderwoman David seconded to name the Brandon Valley Journal as the official newspaper of the City of Brandon for the next year.  Motion carried.
PARK ADVISORY COMMITTEE APPOINTMENT
Alderman Kull moved Alderwoman David seconded to approve the appointment of Jon Jacobson to a 4 year term on the Park Advisory Committee.  Motion carried.
PLANNING AND ZONING APPOINTMENTS
Alderman Kull moved Alderwoman David seconded to approve the appointments of Alica Thiele and Brian Heidbrink to 4 year terms on the Planning & Zoning Commission.  Motion carried.
REVOLVING LOAN FUND FOUNDATION APPOINTEE
Alderman Kull moved Alderwoman David seconded to approve the appointment of Alderman Jorgenson to serve a 2 year term on the Brandon Revolving Loan Fund.  Motion carried.
LIBRARY COMMITTEE APPOINTMENT
Alderman Kull moved Alderwoman David seconded to approve the appointment of Alderman Jorgenson to the Library Committee.  Motion carried.

Alderman Kull moved Alderwoman Clark seconded to approve the easement requests from Midco, as presented.  These easements will be located on property owned by the City, and will lessen the impact on the adjacent private properties.  Motion carried.
SALARY REVIEW AND ADJUSTMENT
The Streets Committee report was heard.  Alderman Jorgenson moved Alderwoman David seconded to approve the annual salary adjustment for Rollie Hoeke, to step 23-11 on the wage scale, $44.01 per hour, effective May 5, 2021.  Motion carried.
2022-2026 DRAFT CIP
A draft CIP was presented, for review only.  A final plan will be submitted to the Council at later date.
CORE PHASE I WARRANTY PROPOSAL FROM HDR
Alderwoman Clark moved Alderwoman David seconded to approve the 1 year warranty work contract with HDR Engineering for the Core Phase I project, as presented.  Motion carried.
TREE DISPOSAL SITE
The tree branch disposal site will be open on Saturday, May 22, 2021 from 9:00am to 3:00pm.  
EASTSIDE SANITARY SEWER
Alderwoman David moved Alderman Kull seconded to approve the contract with IMEG for the east side trunk sewer jurisdictional determination and wetland delineation in the amount of $6,876.96.  Motion carried.
WATER METER REPLACEMENT PROJECT CHANGE ORDER
Alderwoman Clark moved Alderman Jorgenson seconded to approve change order #2 in the amount of ($1,705.26) to Ferguson Waterworks for the water meter replacement project.  Motion carried.
WATER METER REPLACEMENT PROJECT
Alderman Kull moved Alderwoman David seconded to approve pay application #2 and final in the amount of $10,827.54 to Ferguson Waterworks for the water meter replacement project.  Motion carried.
At 7:25 p.m. Alderwoman David moved Alderman Parliament seconded to go into executive session to discuss potential litigation, per SDCL 1-25-2.3.  Motion carried.  At 7:30 p.m. Council President Fish declared the executive session ended.
At 7:31 p.m. on a motion by Alderwoman David seconded by Alderwoman Clark the meeting was adjourned.  Motion carried.

The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, April 29, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson and David Kull.  Jack Parliament was present via phone.  Others present were: City Administrator, Bryan H Read; Finance Officer, Christina Smith; City Engineer, Tami Jansma; Public Works Director, Rollie Hoeke; Fire Chief, Robert Dykstra; Police Chief, Jamie Steffel; Golf Course Manager, Andrew Bauer and Park Superintendent, Devin Coughlin.  Absent: None.
The Council discussed items on the agenda for the upcoming May 3, 2021 regular Council meeting.  No formal action was taken.

PLANNING & ZONING COMMISSION
The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on April 1, 2021 at the Brandon City Council Chambers. 
Roll call was taken.  Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Building Official Paul Clarke and City Engineer Tami Jansma.  Absent were Commissioner Jim Starzl and City Administrator Bryan Read.
Commissioner Noem moved Commissioner Parsons seconded to approve the agenda.  Motion carried.
Commissioner Thiele moved Commissioner Schoeneman seconded to approve the minutes of the March 18, 2021 regular meeting.  Motion carried.
A public hearing was held, as advertised, to consider a Re-Zone Application for 300-320 S. Main Avenue.  This location is Brandon City Hall/Police Department and would re-zone to IN-Institutional District.  Commissioner Heidbrink moved Commissioner Parsons seconded to approve the Re-Zone Application as presented and made recommendation to City Council for approval.  Motion carried.
Discussion held on off-street parking regulations as they pertain to Heavy Industrial zoned districts.  Current city ordinance requires a conditional use for loading areas, access aisles and maneuvering and drive areas that are to be located within the front setback.  Patrick Andrews, SECOG, will draft new language and present at a future meeting.
Building Permits for March were presented: #20210028 - #20210062.  No action required.
At 6:44 p.m., having no further business, Commissioner Parsons moved Commissioner Noem seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

Concrete Pavement Restoration and Joint Re-Seal
Brandon, South Dakota
Sealed bids will be received by the City of Brandon, South Dakota, at City Hall at 304 Main Avenue, P.O. Box 95, Brandon South Dakota 57005 until 2:00pm, local time, May 27th, 2021 and then will be publicly opened at 308 Main Avenue and read immediately thereafter.
The project generally consists of joint re-sealing, PCC panel and joint repairs, and curb and gutter repairs along Holly Boulevard and Aspen Boulevard.

Upon request, a bidder who intends, in good faith, to bid upon the project, one paper copy of the bidding documents will be furnished at no charge.
Bid shall be submitted on the prescribed form. Bids will be rejected if they show any conditions or uncalled for alternative bids. All bids shall be on the basis of cash payment according to the terms of the bidding documents.
The submittal of the Bid will constitute an incontrovertible representation by Bidder that the Bidder has examined carefully the bidding documents, visited the site, is familiar with the local conditions under which the work is to be performed, and correlated bidder’s observation with the requirements of the bidding documents. 
Each bid shall be accompanied by a Bid Security as specified in the bidding documents. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time.
The City of Brandon reserves the right to retain the bid security of the three lowest bidders for a period not to exceed 30 days after the date and time set for opening of the bids. The City of Brandon reserves the right to reject any and all bids or any parts thereof.
